Parental Visa

 The Parental Visas allow parents of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia. Immigration offers different pathways for Parental Visas depending on different circumstances such as previous and current Australia visa (if any), age, time you are willing to wait until a decision is made, or wiliness to pay high fees to fast track the decision process.

Although some specific requirements for this program vary according to the pathway chosen, to be eligible you must meet the following main requirements:

  • Be sponsored by one of your children who must be an Australian citizen, Australian Permanent resident or an eligible New Zealand citizen.
  • Meet the balance of family test.

The balance of family test aims to determine your ties with Australia. To meet the requirements you need to:

  • have at least half of your children live permanently in Australia

or

  • have more of your children live permanently in Australia than in any other country

Partner Visa

The Partner (Provisional and Permanent) Visa Program allows you to live in Australia if you are the spouse or de facto partner of an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.

It is a two stage application process and to be eligible you must be married or in a de-facto relationship for at least 12 months immediately prior to the visa application. Some special circumstances can waive the 12 months period for de-facto relationships, or if your relationship has been registered in Australia.

During the first stage of the application, both partners need to demonstrate this is a genuine and continuing relationship through the following:

  • Provision of a history of your relationship such as when, where and how you met, how the relationship developed, and when you decided to get married or start a de-facto relationship.
  • Financial evidence of your relationship such as joint accounts, sharing household bills and expenses.
  • Nature of household living such as joint rental information, correspondence address to both on the same address, responsibility for day-to-day house tasks.
  • Social context of the relationship such as joint invitations, joint travel, statutory declaration from family and friends.
  • The nature of your commitment to each other such as knowledge about each other’s background, likes and dislikes, term of your wills etc.

The second stage usually takes place two years after the first stage of the visa application. This stage aims to determine if the relationship is still genuine and continuing.

Starting a Business in Australia

Immigration provides different paths for people who want to own and manage a new or existing business in Australia. One path is to establish a business in Australia and become a Standard Business Sponsor.

To be approved as a Standard Business Sponsorship, you need to:

  • legally establish a business in Australia,
  • demonstrate that you are taking steps towards a start to trading, and
  • demonstrate your commitment toward training Australian employees.

To legally establish a business, you will need to register an Australian Business Number and / or an Australian Company number.

As a new business, you can provide evidence of operation by showing a detailed business plan, lease agreements, contracts to provide goods or services, evidence of advertising and marketing, and other such business information.

We will provide guidance throughout the whole process including the gathering of relevant evidence that demonstrates your business is moving towards a start of trading.

We will also identify the best way for your business to meet the Department of Immigration training requirements.

Once the Standard Business Sponsorship is approved, the next step is to nominate the employee who will be sponsored by your business.

A relevant occupation from the skilled migration list will be selected to fulfil the position and we will provide guidance to identify salary, market rates, employment contracts and job descriptions in accordance to immigration requirements.

Once the nomination is approved, we will complete the visa application.

Part of this process includes providing the Department of Immigration with evidence that the nominated employee is fit for the position and possesses the correct qualifications and level of English required.

Skilled Migration

The Australian Government has introduced the Skilled Migration Program to allow overseas skilled professionals to migrate, work and settle in Australia permanently.

To be eligible for the program you must:

  • Demonstrate skills and qualifications that match an occupation in the Skilled Occupation List (SOL),  released by the immigration.
  • Have your skills assessed by a specific Australian assessment authority based on your occupation.
  • Pass a points based test which combines specific criteria such as; age, English language ability, recent work experience and bonus points.

After your have demonstrated that you have the necessary requirements for the program, the next step is to:

  • register an express of interest (EOI) with the Department of Immigration
  • Wait to receive an invitation from the Department of Immigration. Upon receiving the invitation, the visa application is lodged
